Home Inspections Pre-sale Can Limit a Seller's Liability

 

You've closed the sale of your house, deposited your check, and are set to go on with your life. But one morning two months after the sale, you get a registered letter: Your buyer has discovered asbestos in the insulation around the heating ducts in your former home and now demands big bucks from you for cleanup and replacement. Are you liable? It depends.

Forty years ago, no question, the buyer would have had an uphill job collecting anything from you. "Let the buyer beware." But these days, many states--California and Arizona are two examples--and some localities, have enacted disclosure laws. Sellers are required by law to tell potential buyers about any defect in the property that they know about--or that they should know about. Some disclosures, such as the presence of lead paint, are mandated by federal law, and apply in every state.

In the scenario above, if you sold your house in a state or locality with a disclosure law, and you knew about the asbestos and didn't tell the buyer, you're in trouble. At the very least, you've got a lawsuit to defend. Even if your state doesn't have such a law, a court might find you liable for deliberately concealing such an important fact about your property.

If, on the other hand, you didn't know about the asbestos, and you can prove that you did everything you reasonably could to tell the buyer about any potential problems, you're in a much stronger position.

One way to reduce potential liability for hidden defects in a house you sell is to order a pre-sale home inspection. Home inspections cover material matters like roof, plumbing, attic, wiring, furnace, air conditioner, and foundation. Such an inspection can be ordered by either the seller or the potential buyer, and is customary these days for buyers. But a thorough seller's inspection, sometimes called a pre-listing inspection, would have caught the defective asbestos insulation issue in our example above not only before the sale, but before the house even went on the market.

The asbestos problem could have been cleaned up by a contractor of your choice, on your time scheme, and under your control, and the cost could have been rolled into your sale price. And you could have shown the inspector's report, with proof of repair, to the buyer. You'd have proof, from a professional, independent third party, that you had disclosed everything you knew about the property, and the buyer wouldn't have had a leg to stand on.

A pre-sale home inspection, paid for by the seller, can definitely help to limit the seller's liability for property defects discovered by the buyer afterwards. And, it can help the seller fulfill his responsibility to comply with disclosure laws and regulations. Each state has its own requirements and its own forms. Filling out those forms adequately can be a challenge. A seller's inspection report will have all the information necessary to complete those forms and will also serve as supporting documentation for the seller's disclosure.

A seller's inspection can also save time and inconvenience for all parties. The second most common deal breaker in home sales is a problem discovered during a buyer's inspection. Sales have gone west because the seller didn't disclose that there was no hardwood floor underneath his Persian rug, or because he removed a potted ficus tree from its place next to the front door.

A seller's inspection gives the seller a head's up on any potential problems so they can be dealt with before the buyer's inspection is performed, or even ordered. A seller's inspection can be a benefit to all parties--a win-win-win.

The inspector's report is written proof that the seller has disclosed everything he knew about the property. It's the ultimate gesture of truth-telling. It should not only serve as proof of full disclosure but also provide protection against future legal claims. And, it may relieve a prospective buyer's mind of any unfounded suspicions he may have about the seller's integrity and good faith.

A common myth about seller inspections is that they may kill a deal. But any problem big enough to kill a deal will probably be discovered eventually, anyway. If it's discovered ahead of time, before the potential buyer comes into the picture, the seller has time to repair the damage, or to negotiate an adjustment with the buyer without the restraints imposed by an impending closing, when negotiations are handled by counter offers with deadlines of days, if not hours.

Another argument says a newer home in good condition doesn't need an inspection, so why should the seller go to the extra expense? But even in that situation a seller's inspection can be a benefit. Because a home inspector is an independent, objective outsider, his or her report can be a persuasive piece of marketing material.

But in these litigious times, the best argument for having a pre-sale, pre-listing, seller's inspection done is protection from future legal claims. The inspector's report is proof that the seller has met his obligations for full disclosure and that he has acted forthrightly to inform the buyer of any defects he knows about. So if that ominous registered letter arrives at your front door, you'll be ready.
